Terms of Service for Write Forward

Welcome to Write Forward ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our journaling application ("App"). By accessing or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Agreement

By using the App, you agree to comply with and be legally bound by these Terms, whether or not you become a registered user of the App. These Terms constitute a binding legal agreement between you and Write Forward.

2. Services Provided

Write Forward provides a journaling application that allows you to create journal entries, receive personalized analyses using artificial intelligence, and interact with a chatbot designed to help you work through your thoughts and feelings. The App also stores all journal entries, analyses, and chatbot conversations securely.

3. User Responsibilities

• Account Creation: You must create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• User-Generated Content: You are solely responsible for the content you create and post within the App. You agree not to use the App for any unlawful purpose or to post any content that is harmful, abusive, or otherwise inappropriate.

• Compliance with Laws: You agree to comply with all applicable local, state, national, and international laws and regulations when using the App.

4. Data Collection and Usage

• Data Collected: We collect certain information when you use the App, including personal information (such as your username, password, and email address), content information (such as your journal entries, analyses, and chatbot conversations), and analytics data (such as user actions, session information, and device information).

• Data Storage and Security: We store your data securely in a cloud-based PostgreSQL database managed by Neon. We use encryption and other security measures to protect your data both in transit and at rest.

• Third-Party Services: We may use third-party services such as PostHog for analytics, Neon for database management, Vercel for hosting, and authentication providers like Google, GitHub, or Auth0 for user authentication.

5. User Rights and Control

• Access, Modification, and Deletion: You have the right to access, modify, or delete your data by contacting our support team. You can also request the deletion of your account and all associated data at any time.

• Data Retention: We retain your data for different periods depending on whether you are a free or paid user. Free users' data is retained for 6 months after the last activity, while paid users' data is retained indefinitely unless you request deletion.

6. Intellectual Property

• Ownership: Write Forward retains all rights, title, and interest in and to the App, including all intellectual property rights. You retain ownership of the content you create within the App. By using the App, you grant us rights to process your content solely in an automated manner for the purposes of operating (e.g., for indexing, backups, or AI analysis). and improving the App. This means your content will only be accessed by automated systems and will not be viewed, shared, or disclosed to any person, including internal staff.

7. Termination

• Termination by User: You may terminate your account at any time by deleting it through the App or by contacting our support team.

• Termination by Write Forward: We reserve the right to terminate or suspend your access to the App at any time, with or without cause, and with or without notice.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Write Forward shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.

10. Indemnification

You agree to indemnify, defend, and hold harmless Write Forward, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your use of the App or your violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

12. Changes to Terms

We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
